YOUR AGREEMENT WITH ROYAL EMPIRE SUPREME TRAVELS

 

 Before we make arrangements for your flight, hotel, car rental, tour, cruise, or other trip, we require that you sign this form; your signature will signify your agreement with the following terms and conditions:

 

 ROYAL EMPIRE SUPREME TRAVELS L.L.C., (“REST”) acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary (“Suppliers”). REST is not responsible for acts or omissions of the Suppliers or their failure to provide services or to adhere to their own schedules.

 

 REST assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; or (3) any wrongful or negligent acts or omissions on the part of any other party not under REST’s control. You hereby release REST from all claims arising out of any problem covered in this paragraph.

 

 You acknowledge and understand that cruise lines, tour operators, and other Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and that you may be bound by those contracts regardless of whether you receive notice of their terms.

 

 REST has no special knowledge regarding the financial condition of the Suppliers,, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For information concerning possible dangers at destinations, REST recommends contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov. For medical information, REST recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). You hereby release REST from all claims arising out of any problem covered in this paragraph, and to submit all other claims against us within 30 days after the return of your trip. You agree that the courts in {county name} will be the exclusive jurisdiction for all the claims brought by you or REST, and you hereby submit to the personal jurisdiction of those courts.

 

 For your protection, we strongly recommend that you purchase the trip cancellation insurance and that you check the appropriate box within our Travel Insurance Form below. We also strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased.


CREDIT CARD AUTHORIZATION AND CONSENT

 

1. If you are taking advantage of our R.E.S.T. Easy Pay Installment Plan, there is also a one time $50-$149.99 per person payment plan fee due for each person that will be booked with a payment plan for booking. Each payment after the initial deposit or payment does not require the payment plan fee of $50-$149.99 per person to be included. If you are not sure which fee applies to be sure to ask your consultant before submitting payment. It is the responsibility of each client to maintain accurate balance and payment history information regarding their booking and reservation status and payment dates. Our Travel Consultants are not responsible for client payment history or balance information. While we make every effort to provide up to date information, our Travel Consultants are not liable for any errors or omissions.

2. Payments are processed in the order received. Please keep in mind that all the payments and deposits made to Our Travel Consultants are non-refundable and non-transferable unless travel insurance is purchased.

3. You are encouraged to purchase travel insurance to protect your investment. There are no refunds after the final payment due dates.

4. You will receive an email to notify you that your payment was received successfully.

5. All payments are processed according to the Central Standard time zone. Your final payment for your entire reservation is due by your final payment due date by 11:59 pm Central Standard Time. If you fail to make your payment or late payment extension by the due date by 11:59 pm Central Standard Time, your reservation is considered past due and will incur an immediate cancellation and additional fee of $150.00 per person. If you fail to set up a refund request before your final payment due date, your reservation will cancel due to non-payment at 11:59 pm on your final payment due date. At this time, there are no late payment arrangements. No refunds will be given on reservations that cancel due to non-payment and travel insurance will also be voided if the request for a refund or cancel is not received and approved in writing before the final payment due date along with the cancellation fees. There are no exceptions. Reservations automatically cancel and cannot be retrieved. Reservations that cancel with travel insurance are only fully refundable if paid in full. All reservations with travel insurance that are not paid in full will only receive a refund of the deposit paid less the cost of travel insurance and cancel fees. There are no refunds after the final payment due dates. 

6. All declined payments or returned payments are subject to a $35.00 returned item/declined fee.

 

Group Bookings:

If you have booked with a group and the entire reservation is not paid in full by the final payment due date, your entire reservation will cancel. Please be aware of this policy when booking your vacation with other passengers. If one passenger in your group fails to pay, the entire reservation will be canceled and past due and cancel and late fees will be due for each passenger on the reservation when booked as a group. All passengers listed on the same reservation have to pay in full by the final payment due date to prevent the cancellation of the entire reservation. All components on group bookings have to match. For example, if travel insurance is selected, every passenger on the group booking reservation has to purchase travel insurance. There are no refunds after the final payment due dates.

All group packages are required to have travel protection. If you elect to opt-out of adding Travel Insurance protection, you agree and understand that you will be charged $175pp and any funds paid towards your vacation are non-refundable and will be forfeited if you have to make any changes and cancel your vacation. Change fees will be based on the rules of the airline and hotel, etc. and start at $150 per person. All cancellations require a $75-$500 per person cancellation fee, even those with Travel Insurance protection. Refunds will not be granted until the cancellation fees are received. Travel Insurance protection rates vary based on the number of days traveling and destination and will be disclosed to you during the booking process by Our Admins/Travel Consultants.

COMPANY POLICIES

1. You must accept our Terms and Conditions before any payment will be accepted or vacation will be booked. If you book travel with us without signing this form, you agree to and acknowledge all of our terms, conditions, and policies on our website. Please note: If you submit a payment or book travel with our Admin from our Facebook group, you agree to our Terms and Conditions whether you elect to sign this form or not.

2. You must register in the name of your government-issued ID you will use for travel.

Ex., if your passport is in your maiden name you must register in your maiden name. Please understand that you are responsible for any name change fees.

3. All payments are NON--REFUNDABLE & NON--TRANSFERABLE. The only refunds allowed are bookings with travel insurance. Refunds given with travel insurance will include a cancellation fee of $75 per person and less the cost of travel insurance. There are no refunds for no shows. If your reservation is canceled due to non-payment, there are no refunds. There are no refunds after the final payment due dates.

4. You must make payments on your reservation after your initial first deposit with Easy Pay Installment Plans. Any payment amount of $50 or more is acceptable.

5. If you fail to make at least one payment before the month of your final payment due date with Easy Pay Installment Payment Plans, your reservation is subject to cancellation and any previous deposits will be forfeited and your room will be resold. If you are falling behind on payments, please contact us to bring it to our attention or we can only assume you have abandoned your reservations.

6. Rates are subject to change. Late fees of $50 per person are due after the final payment deadline. Late payments are only accepted by approval of management. You must let us know in advance.

7. No name changes allowed without travel insurance. Name change fee of $150 with travel insurance.

8. Account summaries are sent to everyone sharing a room. No individual summaries can be requested. It is the responsibility of each client to maintain accurate balance and payment history information regarding their booking and reservation status and payment dates. Our Admins/Travel Consultants are not responsible for client payment history or balance information. While we make every effort to provide up to date information, Our Admins/Travel Consultants are not liable for any errors or omissions.

9. All payments are processed according to the Central Standard time zone. Your final payment is due by your final payment due date by 11:59 pm Central Standard Time. If you fail to make your payment or late payment by the due date by 11:59 pm Central Standard Time, your payment is considered past due and will incur cancellation and additional cancel fees. If you fail to set up a refund request prior to your final payment due date, your reservation will cancel due to non-payment at 11:59 pm on your final payment due date. No refunds will be given on reservations that cancel due to non-payment and travel insurance will also be voided if the request for a refund or cancel is not received and approved in writing prior to the final payment due date along with the late/cancel fees. There are no exceptions. Reservations automatically cancel and cannot be retrieved. There are no refunds after the final payment due dates.

10. Travel insurance must be paid in full in order to use. You only have 7 days after your booking date to cancel travel insurance. All bookings without travel insurance are nonrefundable. Travel insurance is due in full and must be paid in full within 7 days of booking when added to your reservation. If it is not paid in full in 7 days, it will be dropped from your reservation and your reservation will be nonrefundable at that time. Reservations that cancel with travel insurance are only fully refundable if paid in full. All reservations with travel insurance that are not paid in full will only receive a refund of the deposit paid less the cost of travel insurance and cancel fees. There are no refunds after the final payment due dates.

All payment plan processing fees are non-refundable and non-transferable.

 

Release of Liability and Hold Harmless

In consideration of the opportunity to participate in the above-named travel on dates indicated above, I voluntarily acknowledge and agree to the following:

I agree for myself, my heirs and assigns, executors and administrators to hold harmless and release Our Admins/Travel Consultants or any other vendors or organization(s) and/or subsidiaries, affiliates, officers, representatives or successors (released parties?) from any and all losses, causes of action, liabilities, indirectly from participation in connection with my travel and/or the condition of the property, facilities or equipment used for my trip, regardless of when, where or how such claim may arise and regardless of whether caused by the disappearance of negligence of the Released Parties or otherwise, including, without limitation. Claims relating to (i) any theft, loss or disappearance of property, (ii) bodily injury (fatal or non-fatal) and (iii) property damage.

The agreements will be constructed broadly to prevent claims and lawsuits to the maximum extent permissible under applicable law. Any provisions found to be void or unenforceable shall be modified or deleted to the minimum extent necessary to make them enforceable, and shall not affect the enforce-ability of any other provisions.


BOOKING AGREEMENT

By booking with Our Admins/Travel Consultants, you have read this agreement and you fully understand these terms, and you recognize that you have given up rights by booking with Our Admins/Travel Consultants in consideration of being permitted to participate in our travel services and payment plan options. You agree to these terms voluntarily and without any inducement or duress. Airline change/cancel fee of $200 applies once it is ticketed. This fare must be paid in full and ticketed within 4 days from when the reservations were made.

 

RESERVATIONS AND PAYMENT - All balances are due 45 days prior to departure. Special payment policies may apply and will be advised at time of reservation. If payment is not received by the due date, airline and all other reservations will be canceled. Our Admins/Travel Consultants are not responsible for any penalties, fare increases or fees incurred due to late payment. Submission of payment to Our Admins/Travel Consultants signifies the acceptance of the Terms & Conditions of Sale.

 

FORMS OF PAYMENT - Payment may be made by money order, cashiers check, debit and credit cards from American Express, Visa, MasterCard, Discover Card, Invoice, Zelle or Venmo. All returned items are subject to a $35 service charge.

 

LAST-MINUTE RESERVATIONS - Reservations are accepted up to the day of departure, subject to availability. International destinations may require up to three days' advance notice. A special handling fee of $50 per booking will be assessed to reservations accepted within 14 days of departure for all bookings that are considered last minute.

 

CANCELLATIONS & REFUNDS - Our Admins/Travel Consultants will assess a fee for cancellations, which will not exceed the total vacation package price, plus $75 per person in cancellation costs. Additional airline, hotel and/or supplier fees may also be charged. Airline cancellation policies applies to all bookings in addition to Royal Empire Supreme Travels policy. Once travel has begun, there will be no refunds for any unused or partially used travel component for any reason. While every effort will be made to provide all items on the travel itinerary as booked, Our Admins/Travel Consultants reserves the right to cancel or alter any reservation for any reason prior to departure. Should this occur, refunds will be made without any further obligation by Our Admins/Travel Consultants. If you fail to set up a refund request prior to your final payment due date, your reservation will cancel due to non-payment at 11:59 pm on your final payment due date. No refunds will be given on reservations that cancel due to non-payment and travel insurance will also be voided if the request for a refund or cancel is not received and approved in writing prior to the final payment due date along with the late /cancel fees. There are no exceptions. Reservations automatically cancel and cannot be retrieved. Reservations that cancel with travel insurance are only fully refundable if paid in full. All reservations with travel insurance that are not paid in full will only receive a refund of the deposit paid less the cost of travel insurance and cancel fees. There are no refunds after the final payment due dates. With respect to the travel arrangements made in connection with this transaction, Our Admins/Travel Consultants represents and acts as agent for disclosed principals and independent contractors, including carriers, transportation companies, tour operators, wholesalers, service companies, hotels, etc. Our Admins/Travel Consultants are not responsible or liable for any acts, omissions, financial stability, delays or changes by any of these entities. Neither Our Admins/Travel Consultants nor any of its representatives shall be or become liable or responsible for any loss, injury, damage to person, property, or otherwise in connection with any accommodations, transportation or other services resulting directly or indirectly from any extraordinary circumstances, including but not limited to acts of God, dangers incident to the sea, fire, breakdown in machinery, acts of governments, de jure or de facto, war, hostilities, civil disturbances, strikes, riots, thefts, epidemics, medical quarantines, customs regulations, defaults, delays or cancellations of or changes in itinerary, routing or schedules from any cause beyond the control of the Our Admins/Travel Consultants or from any loss or damage resulting from insufficient or improperly issued passports, visas or other documents. The above information is intended to assist you with your travel plans but does not necessarily represent complete and up-to-date travel information for your specific plans.


NO-SHOWS - Failure to travel without prior notification is considered a no-show and the entire cost of the reservation is non-refundable, subject to policies and procedures of the providers of travel and accommodations.

 

CHANGES AFTER DEPARTURE - No refunds will be granted on unused services once travel has commenced. Our Admins/Travel Consultants will assess a $200 per person fee for changes made after the commencement of travel. Changes in return transportation to the extent permitted by carrier(s)' tariff may be made only through Our Admins/Travel Consultants representatives. Changes in travel arrangements that result in additional monies owed due to price differences, fuel surcharges, ticket re-issuance fees, etc. are due and payable directly to Our Admins/Travel Consultants representatives at the time of change.


LIMITATION OF LIABILITY - By making a reservation, the customer acknowledges that in all events, Our Admins/Travel Consultants shall not be liable for any incidental or consequential damages and that the sole extent of Our Admins/Travel Consultants liability, if any, shall never exceed the amount actually paid by customer to Our Admins/Travel Consultants.

 

ACCOUNT SUMMARIES - Account summaries are sent to the group coordinator for bookings of shared rooms. No individual summaries can be requested. It is the responsibility of each client to maintain an accurate balance and payment history information regarding their booking, reservation status, and payment dates. Royal Empire Supreme Travels is not responsible for client payment history or balance information. While we make every effort to provide up to date information, Royal Empire Supreme Travels is not liable for any errors or omissions by the vendors or misinformation provided by the client.

 

PASSPORTS AND VISAS - Passengers are responsible for ensuring that they have the proper travel documents and MUST CHECK with the respective consulate(s) or visa agency to determine whether any visas or passports are required. Passports are required to be valid for at least 6 months after the date of travel. Some countries require a full blank “VISA” page in the passport for stamping purposes. Any information provided on travel description pertains to US citizens only. Non-US citizens should check with the respective consulate of the country(s) to be visited for current entry requirements. We strongly suggest that all cruise passengers to have a valid passport in their possession while cruising.

 

GROUP HARMONY - To ensure the desired group synergy, Royal Empire Supreme Travels reserves the right to accept, reject or expel any individual who is deemed disruptive or incompatible with the interests of the group, including, but not limited to, individuals who are intoxicated and/or under the influence of drugs leading to a negative experience for the remainder of the group. Expenses, including cancellation fees and/or costs for alternate travel plans or to return home, will necessarily be borne by the passenger. All unused services are non-refundable.

 

FORCE MAJEURE - Royal Empire Supreme Travels will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or nonperformance of any of its obligations under this agreement to the extent that any such delay or nonperformance is due to any Force Majeure. “Force Majeure” means, in relation to Royal Empire Supreme Travels, any circumstances beyond the reasonable control of Royal Empire Supreme Travels (including, but without limitation, acts of God, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, quarantine, pandemics, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences).

 

If Royal Empire Supreme Travels, and/or any of its’ travel suppliers, are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Payment of any refund by Royal Empire Supreme Travels to you as a result of the non-performance of any obligations hereunder shall remain in its sole and absolute discretion, although Royal Empire Supreme Travels shall use all reasonable efforts to reimburse you where possible. However, Royal Empire Supreme Travels shall be entitled to deduct from any refund recoverable the reasonable actual and potential costs to Royal Empire Supreme Travels of the Force Majeure and applicable cancellation fees.

Regarding civil unrest, once Royal Empire Supreme Travels has investigated the prevailing situation, as it deems fit, it shall remain in Royal Empire Supreme Travels sole and absolute discretion whether to proceed with the trip. You may in such circumstances cancel the trip subject to each supplier’s terms and conditions.

 

TRAVELERS WITH DISABILITIES - In order to enjoy your tour fully, we recommend that you select a trip that is suitable to your physical capabilities. Tour participants requiring any form of assistance, including travelers with physical disabilities, sight or hearing impairments, are required to notify Royal Empire Supreme Travels before reservations for review and our agreement. Additionally, the tour participant must be accompanied by an individual responsible for providing those services. Tour managers, guides, drivers or other tour, hotel, ship personnel are not able to provide such assistance. In order to participate in escorted tours, passengers must be able to understand and follow instructions given by the Tour Director at all times, both for the successful operation of the tour as well as for their safety. Royal Empire Supreme Travels reserves the right to reject participation or remove any individual from a tour if notification was not provided and/or when, in our sole judgment, continued participation would significantly hinder the services to be provided to all guests. Expenses, including cancellation fees and/or costs for alternate travel plans or to return home, will be the sole responsibility of the passenger. Escorted tours are fast-paced, often requiring lengthy walks over uneven terrain. In the interests of group harmony, clients should be able to maintain the pace of the tour. Clients with special needs may be better served independently. Royal Empire Supreme Travels can suggest touring options based upon specific requirements.

 

WHEELCHAIRS AND WALKERS - USA Tours: Pursuant to the Americans with Disabilities Act (ADA), Royal Empire Supreme Travels seeks to accommodate disabled travelers to the extent possible and consistent with the specific tour itinerary. Nevertheless, you may find that certain tour features may not be accessible to the extent that you require a wheelchair, scooter, or other special equipment to participate. We cannot provide individual assistance to travelers with wheelchairs or other mobility devices. We regret that some itineraries cannot accommodate wheelchairs or motorized scooters. Passengers are required to advise Royal Empire Supreme Travels of their accessibility requirements before booking, in order for Royal Empire Supreme Travels to determine if reasonable accommodations are available. Royal Empire Supreme Travels will endeavor to accommodate special access needs, but does not guarantee that it will be able to do so in all cases.

 

INTERNATIONAL TOURS - Hotels, sea and river cruises outside of the United States are not required to comply with ADA requirements and therefore may not have ramps, wide entryways or elevators to accommodate disabled passengers or devices such as wheelchairs, walkers and motorized scooters. Due to physical constraints and space limitations, wheelchairs, walkers and motorized scooters may not be taken aboard motor coaches and river cruises.

 

SERVICE ANIMALS - Service animals cannot be accommodated on international escorted tours. Passengers on USA escorted tours who require a service dog because of a disability should check with Royal Empire Supreme Travels prior to booking a tour. 

Rest Easy Pay Installment Plans

Terms and Conditions

 

R.E.S.T. Easy Pay Installment Plan Options require travel insurance in order to use this service. Travel Insurance protection is required to use our Easy Pay Installment Plan Option in order to protect Our Admins/Travel Consultants and the client from liabilities in the event of a cancellation or issue. If you wish to not purchase travel insurance, written permission from Our Admins/Travel Consultants will be required to use the Easy Pay Installment Plan Options and you will be required to sign a waiver which releases Our Admins/Travel Consultants from any responsibility of any part of your travel, including medical issues or payments.

All packages over $1,000 per person are required to have travel protection. If you elect to opt-out of adding Travel Insurance protection, you agree and understand that you will be charged $75pp and any funds paid towards your vacation are non-refundable and will be forfeited if you have to make any changes and cancel your vacation. Change fees will be based on the rules of the airline and hotel, etc. and start at $150 per person. All cancellations require a $75 per person cancellation fee, even those with Travel Insurance protection. Refunds will not be granted until the cancellation fees are received. Travel Insurance protection rates vary based on the number of days traveling and destination and will be disclosed to you during the booking process by Our Admins/Travel Consultants.

We require a signature of this form along with a copy of your State ID or Driver's license in order to use the Easy Pay Installment Plan option. If we do not receive this form from you within 24 hours of booking, your reservation will be canceled. There are no refunds after final payment due dates.
